Indigo brings Mahindra Before Court over 6e Trademark

Over the use of “6E” branding in Mahindra’s upcoming electric SUV, the BE 6e, leading Indian airline IndiGo, has sued Mahindra Electric Automobile Limited (MEAL) in the Delhi High Court for trademark infringement.

Originally set for Tuesday, the case—which came before Justice Amit Bansal—has been postponed for December 9 following the judge’s recusal. Representing IndiGo, Senior Advocate Sandeep Sethi informed the court that Mahindra contacted the airline on Monday night following initial negotiations between the parties.

Responding to the lawsuit, Mahindra & Mahindra Limited clarified stock exchanges on their mark “BE 6e,” which differs basically from IndiGo’s single “6E” trademark. The company stressed there there is no possibility of uncertainty since their trademark represents an electric car instead of an aeroplane service.

“We hence do not perceive a problem as Mahindra’s mark is “BE 6e,” not the single “6E,” it is not at all like Indigo’s “6E, which shows an airline and removes all risk of ambiguity. ” Their distinctiveness is even more highlighted the numerous styles,” it said.

The case mostly centres on IndiGo’s well-known “6E” brand, which has been essential to the airline’s character since 2015. Under numerous classifications—including advertising, transportation, and passenger services—the airline possesses trademark registrations for “6E Link”. IndiGo names various passenger-centric services—including 6E Prime and 6E Flex—the “6E”.

Mahindra exposed their electric origin SUVs, the BE 6e and XEV 9e, on November 26, 2024. Underclass 12 (cars), the manufacturer registered trademarks for “BE 6e” for the portfolio of electric SUV vehicles. Mahindra Electric’s registration application for “BE 6e” was granted the Trademarks’ Registrar on November 25.

Mahindra responded to IndiGo’s concerns about goodwill infringement in their notification to stock exchanges, attesting to both companies’ participation in negotiations to reach a friendly solution.
